Minor in Possession of Alcohol (MIP) is a violation under Oregon law.
Possession of alcohol can be proven by facts showing the defendant had physical possession, constructive possession, or possession by consumption (breath) of alcohol.
The minimum fine is $181 and the maximum fine is $309.
There is a mandatory one year suspension of a defendant's driving privileges upon a conviction. If this is the first conviction for MIP, the court may lift the suspension after 90 days.
The court also has discretion to order a defendant to submit to an alcohol evaluation by a certified evaluator, and subsequent treatment or counseling.
